If you pass away without a will, Intestate Laws take effect. In the absence of a Will, it is essentially up to the Master of the High Court’s Office to decide how your Estate will be distributed, and this will be done in accordance with South Africa’s Intestate Laws, which conflict with Islamic Law. You won’t be able to control how your assets are dispersed, and it will take significantly longer for your assets, including bank accounts, to become available to your heirs.
